Comulate Wins Court Order Protecting Customers
Court Temporarily Enjoins Applied from Interrupting Customers’ Use and Onboarding of Comulate; Denies Applied’s $10M Bond Request
SAN FRANCISCO – December 16, 2025 – The Delaware Court of Chancery on December 16, 2025 entered an order protecting Comulate customers in response to Comulate's motion for a temporary restraining order (TRO) against Applied Systems. The TRO orders Applied not to interrupt Comulate customers’ access to and use of Applied’s Epic system for purposes of using Comulate’s software—both for those customers already live and in the process of implementing. The Court rejected Applied's request for a $10 million bond.
Courts grant emergency orders only in extraordinary circumstances—when a company presents colorable claims, faces immediate irreparable harm, and the balance of the equities favors the movant. The order will remain in effect pending resolution of Applied's motion seeking to have Comulate refile its claims in a pending federal action in Chicago.
The ruling comes three weeks after Applied filed what Comulate has called a frivolous lawsuit designed to eliminate a competitor it could not acquire or outcompete. Comulate filed its own lawsuit against Applied on December 3, alleging anticompetitive conduct and tortious interference with customer relationships.

Comulate continues normal operations, supporting customers, including those with Applied’s software.
